The reasons for a workers’ compensation denial, what you can do

Regardless of your profession or industry, you could suffer an injury on the job at any time.

If this happens, you need to know a couple things. First off, your health is top priority, meaning that you want to receive immediate medical attention. Secondly, there is always the possibility that you won't be able to return to work right away, meaning that you may want to file a claim for workers' compensation benefits.

Most people who suffer an on-the-job injury assume they can make a workers' compensation claim and immediately receive benefits. Unfortunately, things don't always work out this way.

There are many reasons for a workers' compensation denial, including the following:

  • You did not report the injury in time. It's best to do this as quickly as possible, with an absolute maximum time limit of 30 days.
  • You did not receive medical treatment following the injury. This is a mistake you don't want to make for many reasons. Not only does it harm your ability to receive workers' compensation benefits, but it can also lead to additional health concerns.
  • Your employer states that you were not injured on the job. Since this is a real possibility, you don't want to leave any gray area. This is why you should report the accident and injury as quickly as possible.
  • You are dealing with a non-compensable injury. Not every injury will result in an approved workers' compensation claim.

If you want to make a workers' compensation claim, the most important thing to remember is that there are deadlines governing the process. When you act quickly, you don't have to concern yourself with missing one of these.

In the event of a denial, the best thing you can do is find out the reason for this and then implement a plan of action. This typically means filing an appeal with the idea of having the original decision overturned.

You have rights as an injured worker, so you should never let your employer walk all over you.
