Mental injuries by accident are covered under the North Carolina Workers Compensation Act. Mental impairments are compensable as long as the resulting disability meets the statutory requirements, namely injury by accident or occupational disease requirements.

An injury by accident is defined as “an unexpected, unusual or undersigned occurrence.” Where a Plaintiff develops a mental injury as a result of an interruption of her normal work routine, and the introduction of unusual conditions likely to result in unexpected consequences, the Commission may find an injury by accident occurred.
