If a person does not have an attorney, the Administrative Law Judge has a duty to adequately develop the record. However, it is not a good idea to leave this vitally important function up to the Judge. Rather, a competent attorney can initiate the kind of contact with treating physicians that’s needed to obtain information that will increase the possibility of obtaining benefits.
