What steps do I take to report a workers’ compensation claim?

You’ve been injured in a workplace accident. Do you know how to ensure your medical treatment and missed wages are covered? In North Carolina, there are certain steps you need to take right away to be eligible for workers’ compensation from your employer.

Of course, the most important thing is to seek medical attention for your injuries as soon as possible, particularly if you had an accident. In many cases, your employer will have a designated on-site or off-site health care provider. Treatment from most hospital emergency rooms or your regular provider is also acceptable, especially for immediate needs.

The North Carolina Industrial Commission recommends taking the following steps to initially secure your workers’ compensation eligibility:

  1. Seek medical care as appropriate for your injuries.
  2. Tell your health care provider that your injury is related to work and supply the name of your employer. They then can bill your treatment to the workers’ compensation claim.
  3. Inform the appropriate manager or owner of your place of employment about your injuries as soon as possible.
  4. Within 30 days, provide written notice to your employer giving the date of the accident and a brief description of the injury.
  5. Follow instructions from your provider for medical treatment

In addition to the above steps, you also must fill out a Form 18 and submit it to the Industrial Commission to begin the claims process. Your employer will then fill out and submit Form 19 to the commission.
